TERRY FAWELL: People come into my office with many misconceptions. Some people think that the mom always gets custody. Some people think that at some age the children can say I want to be with mom or dad and they get to decide. Those are not true. And people because of the internet have many of these false ideas. So I try and give them the actual truth.
The divorce court is a court of equity. It’s a court that does what’s in the best interests of the children. There’s no preconceptions here. And everybody’s on equal footing. What distinguishes family law cases from other types of litigation is that it’s important that the parties instead of being adversaries have open lines of communication when the case is done. In more high-conflict cases, where people don’t get along about anything or everything’s an issue, what we try and do is resolve these issues at the outset, enter an agreed order, whereby we set forth when the children will be with each parent, who will pay what bills. And this sets the ground rules so that the case can go on smoothly.
