Criminal Sexual Assault

Illinois does not use the word “rape” in its legal code, nor does it make a distinction between using force and having relations with someone who is incapable of giving consent (i.e., statutory rape).

For a first offense, you can be sentenced to up to 15 years in prison. For a second offense, you can face up to 30 years in prison or, for an extended sentence, up to life in prison. Illinois law also has aggravated sexual assault, which usually involves the commission of another crime.

Criminal Sexual Abuse

Illinois defines criminal sexual abuse either as a Class A misdemeanor or a felony depending on certain circumstances, such as the use of force or threat of force. Essentially, criminal sexual abuse happens when an older person performs a sex act with a minor, since the minor is too young to legally give consent.

Misdemeanor criminal sexual abuse carries up to a year of jail time. A felony offense carries up to 13 years. The judge has the discretion of sentencing you to probation.
