The Financial Impact of Divorce

  • Marital property will be divided equitably. However, this doesn't necessarily mean fifty-fifty.
  • If you have children, the parent without primary physical custody will pay 20 percent of his or her net income in support for one child. This support can be modified after the divorce if the financial circumstances of either side changes.
  • In long-term marriages where one of the parties is financially dependent on the other, the court may order alimony or spousal maintenance during the divorce and after.

Legal Separation and Divorce

Illinois provides for a legal separation as an alternative to divorce. Legal separation accomplishes nothing in the legal sense. You need not be legally separated to move out of the house.
